Welcome to LayLab! These Terms of Service ("Terms") govern your use of our services, website, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Please read these Terms carefully. They include important information about your legal rights, remedies, and obligations.
- "Service" refers to the applications, software, products, and services provided by LayLab.
- "User", "You", "Your" refers to the individual or entity that registers for or uses our Service.
- "Content" means any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Service.
- "Generated Images" refers to images created by users through the LayLab platform.
To use certain features of our Service, you may need to create an account. You must provide accurate and complete information and keep your account information updated. You are responsible for safeguarding your account and for all activities that occur under your account.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are of legal age.
Users retain ownership of the images they generate using the Service, subject to the licenses granted herein. You grant LayLab a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the Generated Images as necessary to provide and improve the Service. You grant LayLab a non-exclusive right to internally reproduce and display Generated Images solely for the purpose of operating, promoting, and improving the Service. We will never resell or sublicense your images to third parties without your explicit consent.
Prohibited uses include generating images that are illegal, defamatory, infringing on intellectual property rights, or otherwise harmful.
We bill in Danish kroner (DKK). Plans are month-to-month, payable via Shopify's subscription billing. Upgrades take effect immediately with prorated charges; downgrades at the next billing cycle. You may request a refund within 14 days of the initial purchase if you have not generated more than 20 images.
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of LayLab and its licensors. The Service is protected by copyright, trademark, and other laws. "LayLab" and its logo are EU-registered trademarks of LayLab ApS. All feedback you submit may be used without restriction.
Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, and share your personal information. Please review our Privacy Policy at Privacy Policy.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination we will erase your store data and images in accordance with our Privacy Policy (see "Data Retention & Deletion").
You may terminate your account at any time by discontinuing use of the Service or by contacting us.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. LayLab makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
In no event shall LayLab or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service. Except for wilful misconduct, our aggregate liability is capped at the amount you paid in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under Danish law (e.g., death or personal injury caused by negligence).
We may modify these Terms with 30 days' notice via email or in-app banner. Continued use after the effective date constitutes acceptance.
These Terms shall be governed and construed in accordance with the laws of Denmark without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Neither party is liable for delays or failures caused by events beyond reasonable control (force majeure), including strikes, power outages, or internet disruptions.
